Terms of Service — Diami

These Terms of Service (“Terms”) are an agreement between you and Trackana (“we”, “us”), the publisher of Diami (“the app”, “the service”) — a property-management app for boarding-house (kos), house, and apartment owners in Indonesia, available on Android, iPhone/iPad, and the web.
By creating an account or using Diami, you agree to these Terms. If you do not agree, please do not use the app. Your privacy is covered separately by our Privacy Policy, which forms part of these Terms.
1. Who can use Diami
You must be at least 18 years old and able to enter into a binding agreement to use Diami. There are two kinds of users:
- Owners — property managers who run one or more properties in the app and hold the account. If you use Diami on behalf of a business, you confirm you are authorised to accept these Terms for it.
- Tenants — residents invited by an owner to view their own bills, rent, documents, maintenance, and announcements.
2. Your account
Owners register with an email and password; tenants join with an invite code from their owner. You are responsible for keeping your login details secure and for activity under your account. Tell us promptly at support@trackana.net if you believe your account has been used without your permission. Keep your account information accurate and up to date.
3. What Diami is — and is not
Diami is a tool that helps owners record and manage properties, tenants, rent, finances, documents, maintenance, and — where smart meters are used — electricity billing.
Diami is not a party to any tenancy, lease, or agreement between an owner and a tenant. We do not provide legal, tax, accounting, or property-management advice, and we are not a landlord, agent, broker, or payment intermediary for rent. Any arrangement, charge, or dispute between an owner and a tenant is solely between them. Owners are responsible for complying with the laws that apply to them, including tenancy, tax, consumer, and data-protection law.
4. Owner responsibilities for tenant data
Owners enter and store personal information about their tenants, which can include identity documents such as KTP and KK. If you are an owner, you represent and warrant that:
- you have a lawful basis and, where required, the tenant’s consent to collect, store, and use their personal information and documents in Diami;
- you will use that information only for legitimate property-management purposes;
- you are responsible, as the party that decides how that data is used, for meeting your obligations to your tenants under applicable data-protection law (including Indonesia’s Personal Data Protection Law).
We provide the app that stores and processes this information on your behalf, as described in the Privacy Policy. You agree to indemnify us against claims arising from your collection or use of tenant data in breach of these Terms or the law.
5. Electricity billing
Where you use Diami’s metering features, the app calculates electricity charges from meter readings (obtained from a smart meter or entered manually). You are responsible for the readings, the rates you set, and the amounts you charge your tenants. Readings can be missing or delayed; when a reading is unavailable, Diami may show a value marked as estimated rather than a guaranteed measurement. Diami is a calculation aid, not a certified metering or billing authority, and we do not guarantee that any bill meets a particular legal or regulatory standard.
6. Acceptable use
You agree not to:
- use Diami for any unlawful purpose, or to store or share content you have no right to;
- upload material that is unlawful, infringing, or harmful, or another person’s data without a lawful basis;
- attempt to access accounts or data that are not yours, or bypass the app’s security or access controls;
- interfere with, overload, reverse-engineer, or disrupt the app or its infrastructure;
- resell or provide the service to third parties except as intended (an owner inviting their own tenants).
We may suspend or limit access to protect the service or other users, or where we reasonably believe these Terms have been broken.
7. Plans, payments, and renewals
Diami offers a free tier and one or more paid plans that unlock additional features (such as smart-meter automation and higher limits).
- Payment is handled by our payment provider, Midtrans. You complete payment on Midtrans’ secure page; we do not receive or store your card, bank, or e-wallet details.
- Prices are shown in the app in Indonesian Rupiah and may include applicable taxes. We may change prices for future purchases; changes do not affect a period you have already paid for.
- Term and renewal. A paid plan runs for the period you purchase. We will remind you before it ends. Unless the app clearly states a plan renews automatically, your plan does not charge you again by itself — you choose whether to renew.
- Downgrade / non-payment. If a paid plan lapses, features that depend on it (including some tenant access) may be limited or paused until you renew. Your recorded data is retained subject to the Privacy Policy.
- Refunds and cancellation. How refunds, cancellation, and renewals work — including a short good-faith refund window and full refunds for duplicate charges or service faults — is set out in our Refund & Cancellation Policy.
Where you buy through the Apple App Store or Google Play, that store’s payment and refund terms may also apply.
8. Third-party services and hardware
Diami works with third-party services — including Supabase (hosting), Midtrans (payments), Google/Firebase (notifications), and the app stores — and, optionally, with smart-meter hardware and gateways. Those services and devices are provided by others and are subject to their own terms; we are not responsible for their availability, accuracy, or acts. We do not sell or warrant smart-meter hardware unless expressly stated in writing.
9. Your content and our rights
The data and content you enter remain yours. You grant us a limited licence to host, process, and display that content only as needed to provide the service to you and the people you share a property with, as described in the Privacy Policy. Diami itself — the app, its design, and its trademarks — remains the property of Trackana, and these Terms do not give you any right to it beyond using the app.
10. Availability and changes
We work to keep Diami available and reliable, but we provide it on an “as available” basis and may update, change, or discontinue features. We will give reasonable notice of significant changes where we can. The app may occasionally be unavailable for maintenance or reasons beyond our control.
11. Disclaimers
To the extent permitted by law, Diami is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted or error-free, or that calculations, readings, or reminders will be complete or accurate. Nothing in these Terms excludes any rights you have under mandatory consumer-protection law that cannot be excluded.
12. Limitation of liability
To the extent permitted by law, Trackana will not be liable for any indirect, incidental, or consequential loss, or for loss of profit, revenue, data, or goodwill, arising from your use of (or inability to use) Diami. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the claim. This does not limit liability that cannot be limited by law.
13. Suspension and termination
You may stop using Diami and delete your account at any time (see Account & Data Deletion in the Privacy Policy and the deletion page). We may suspend or end your access if you materially breach these Terms or the law, or to protect the service or other users. On termination, your right to use the app ends; data handling follows the Privacy Policy.
14. Governing law
These Terms are governed by the laws of the Republic of Indonesia, and any dispute relating to them or to Diami is subject to the jurisdiction of the Indonesian courts, without prejudice to any mandatory consumer rights you have where you live.
15. Changes to these Terms
We may update these Terms as Diami evolves. Material changes will be reflected by the “Last updated” date above and, where significant, communicated in the app. If you keep using Diami after a change takes effect, you accept the updated Terms.
