Terms of Service — Tahwil

These Terms of Service (“Terms”) are an agreement between you and Trackana (“we”, “us”), the publisher of Tahwil (“the app”) — a personal Islamic worship and learning companion with prayer times, Quran, habit tracking, and a structured Arabic curriculum.

By using Tahwil, you agree to these Terms. If you do not agree, please do not use the app. How the app handles data is covered separately by our Privacy Policy, which forms part of these Terms. In short: Tahwil is a local-first app — it has no accounts and keeps your data on your device.

1. Who can use Tahwil

Tahwil is suitable for a general audience. If you are under the age required to agree to these Terms where you live, you may use the app only with the consent and supervision of a parent or guardian, who accepts these Terms on your behalf. Tahwil is not directed to children under 13, and we do not knowingly collect personal information from them (see the Privacy Policy).

2. No account — your data is on your device

Tahwil does not require an account and stores your worship logs, learning progress, and settings on your device. This means:

• You are responsible for your own data. Because your data is not stored on our servers, we cannot recover it for you. If you uninstall the app, clear its storage, or lose your device, that data may be lost. Keep your own backups where your device allows.
• You are responsible for keeping your device secure.

3. Religious content — please verify

Tahwil provides prayer times, Qibla direction, the Hijri calendar, Quran text and translations, tajweed guidance, du’a, and Arabic-learning material for your convenience and study.

These are aids, not religious authority. Prayer times and Qibla are computed from your location using calculation methods that can differ between authorities; the Hijri date can differ from local moon-sighting; and Quran text, translations, and learning content are drawn from established sources but may contain errors. For matters of worship, you should verify with a qualified scholar and your local authorities. We do not guarantee that any time, direction, date, or text is correct for your situation, and we are not responsible for reliance on them.

4. Acceptable use

You agree to use Tahwil lawfully and respectfully, and not to:

• copy, redistribute, or resell the app or its content except as the app allows;
• reverse-engineer, tamper with, or disrupt the app;
• use the app in any way that infringes others’ rights or breaks the law.

5. Third-party services

When you use the “nearby mosques” feature, Tahwil queries the OpenStreetMap Overpass service to find mosques near you; that service is provided by others and is subject to their own terms (see the Privacy Policy). The app is distributed through the Apple App Store and Google Play, whose terms also apply to your download and use.

6. Price

Tahwil is currently provided free of charge. If we introduce optional paid features in the future, they will be clearly marked, purchased through your app store, and subject to that store’s payment terms and any additional terms we present at the time.

7. Intellectual property

The app, its design, and its trademarks remain the property of Trackana. Quran text, translations, fonts, and other third-party content are used under their respective licences and remain the property of their owners. These Terms give you a personal, non-transferable right to use the app; they do not transfer ownership of anything to you.

8. Availability and changes

We provide Tahwil on an “as available” basis and may update, change, or discontinue features. We aim to keep the app working well but cannot guarantee it will always be available or error-free.

9. Disclaimers

To the extent permitted by law, Tahwil is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose or the accuracy of any content (including prayer times, Qibla, calendar, or Quran text). Nothing in these Terms excludes rights you have under mandatory consumer-protection law that cannot be excluded.

10. Limitation of liability

To the extent permitted by law, Trackana will not be liable for any indirect, incidental, or consequential loss, or for loss of data, arising from your use of (or inability to use) Tahwil, including reliance on any religious content. This does not limit liability that cannot be limited by law.

11. Governing law

These Terms are governed by the laws of the Republic of Indonesia, and any dispute relating to them or to Tahwil is subject to the jurisdiction of the Indonesian courts, without prejudice to any mandatory consumer rights you have where you live.

12. Changes to these Terms

We may update these Terms as Tahwil evolves. Material changes will be reflected by the “Last updated” date above and, where significant, communicated in the app. If you keep using Tahwil after a change takes effect, you accept the updated Terms.
